Terms of use
Last updated: October 7, 2026
These terms apply to everyone who uses the FLOW workspace at https://flowoftheday.com: people with an account, people invited to create one, and outside contacts such as suppliers and service vendors who use a link or portal page. Creative Exit, LLC ("we", "us") runs the workspace for FLOW. By using the workspace, you agree to these terms and to the privacy notice at https://flowoftheday.com/legal/privacy. If you do not agree, do not use it.
Who is responsible for what
Every location (store) in the workspace belongs to its own company. That company decides who at its locations may use the workspace and what they may do, keeps its own records in it, and is responsible for how it uses them. These terms are between you and us. They are not an employment contract and do not change the terms of your job or your employer's policies.
Each store is independently owned and operated by its own company. That company alone is the employer of the people who work there, and it decides their pay, hours and other terms of work. Role names in the workspace, such as manager, describe access only.
Who may use the workspace
You may use the workspace only if a business that uses it invited you or sent you a link, and only for work with that business. You must be at least 13 and old enough to do that work where you are. If you are under 18, a parent or guardian must also agree to the documents you sign in the workspace.
Your account
Keep your password to yourself and use one you do not use anywhere else. Do not share your account or use someone else's. Turn on two-step sign-in, and use it when you are asked to. Tell your manager straight away if you think someone else used your account; until you do, you are responsible for what is done with it. Your employer or we can switch your account off.
What you must not do
- Try to reach records, locations or features you have not been given.
- Enter false records, or sign or confirm anything for someone else.
- Upload anything unlawful, harmful or hateful, or anything you have no right to share.
- Upload photos of customers or of coworkers who did not agree, card numbers, or screens showing other people's information, or use a profile photo of anyone but yourself.
- Add private information the work does not need, such as Social Security numbers, bank details or photos of identity documents.
- Put medical details or complaints about coworkers in shared notes — use an entry that is private to managers.
- Interfere with the workspace, overload it, test its security without our written permission, or collect data from it with automated tools.
- Copy, sell, rent or take apart the software.
Records and what you add
Files must be photos (JPG, PNG, WebP or GIF) or PDFs, up to 10 MB each.
Records and files belong to the company of the location they were created for. You give us permission to store, copy, show and process what you add, only to run the workspace for that company and as the privacy notice describes. Add only what you have the right to share.
Signing electronically
When you sign a document or confirm a step in the workspace — by typing your name or ticking a box — you agree that this is your electronic signature and has the same effect as signing on paper. The workspace keeps the wording you saw, when you signed and how you had signed in, and you can download a copy.
Suppliers and service vendors
A link or portal page may be used only for the order, job or account it was sent for, and must not be passed on. What you send through it — an order confirmation, a quote, an invoice, a photo — goes to the business that sent the link, which may rely on it. Any agreement about the goods or the work is between you and that business.
Text messages
If you agree to receive text alerts, you get work alerts from your employer. How many messages you get depends on your alerts. Message and data rates may apply. Reply STOP to cancel or HELP for help. Carriers are not liable for delayed or undelivered messages. Agreeing to texts is never a condition of your job.
Tools that help, not replace your judgment
The workspace helps you keep food-safety, training, inventory, cash and invoice records, and some features use AI to read invoices and messages. Limits, sample rules, reminders and AI results can be wrong or incomplete. They do not replace your own checks, your employer's policies, or the laws and food codes that apply to you. Check AI results before you rely on them.
Our software
The workspace and its software, design and name belong to us or those who license them to us, and are protected by law. Using the workspace does not give you any ownership of it. Open-source parts are listed in the third-party notices. If you send us suggestions, we may use them without owing you anything.
Availability and changes
We work to keep the workspace running, but it may be paused for maintenance, updates or events outside our control, and we may change, add or remove features. Keep your own copies of any records you are required by law to keep.
Ending access
Your employer or we may suspend or end your access at any time, for example when you leave the business or if you break these terms. The parts of these terms that by their nature should last — such as records, our software, the disclaimer and the limit of liability — continue after your access ends.
Disclaimer
As far as the law allows, the workspace is provided "as is" and "as available", without warranties of any kind, including that it will be uninterrupted, free of errors or fit for a particular purpose. Some places do not allow these exclusions, so they may not apply to you.
Limit of liability
As far as the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, and our total liability to you for any claim about the workspace is limited to one hundred US dollars (US$100). This does not limit liability that the law does not allow to be limited, and it does not affect any right you have against your employer.
Law and disputes
These terms are governed by the laws of the State of California and by United States federal law, without regard to rules on conflicts of law. Before starting a claim, write to us at support@flowoftheday.com and give us 30 days to try to resolve it. A claim that is not resolved goes to the state or federal courts in California, unless the law where you live gives you the right to bring it elsewhere.
Changes to these terms
We may update these terms. The new version is posted on this page with a new date, and for important changes we also tell you in the workspace. Using the workspace after a change means you accept it.
General
If any part of these terms cannot be enforced, the rest still applies. Not enforcing a part is not a waiver of it. You may not transfer these terms; we may transfer them to a company that takes over the workspace. These terms, the privacy notice and the cookie notice are the whole agreement between you and us about the workspace.
